On September 29, 2016, the Superior Court dismissed claims pursuant to the Massachusetts Civil Rights Act and for defamation brought by property owners disappointed by the enforcement actions and decisions of the Town of East Longmeadow’s Planning Board and the Town’s employees. The case was before the Superior Court following remand from the United States District Court for the District of Massachusetts, where Robinson Donovan filed a successful motion to dismiss the plaintiffs’ federal procedural due process and substantive due process claims.
This is the most recent in a series of cases brought by property owners or developers in which Robinson Donovan has successfully obtained dismissal of the complaint at the outset, before its municipal clients were exposed to the costs and burdens of on-going litigation.
