A Useful Tool: Prenuptial Agreements Can Protect Business Interests

When individuals get divorced in Massachusetts, a Probate Court judge has the discretion to award either spouse any assets belonging to or titled solely in the name of the other spouse whether acquired before or during the marriage.

For business owners, especially those who own an interest in a family business, the possibility that the business interest might be claimed or distributed in whole or in part to a previously non-involved spouse or to a soon-to-be ex-spouse is a serious concern.
