Attorney Benjamin Klein - An Act Relative to Bullying In Schools

Governor Deval Patrick signed the much publicized anti-bullying law in May, setting forth new requirements for secondary schools to address bullying. The law covers face to face bullying as well as "cyber-bullying" that may occur over the internet. The law requires most schools to develop plans to address bullying prevention and intervention, which must be implemented by the school principal or person holding a comparable position. These plans must also provide for ongoing professional development for all school staff members, ranging from teachers to bus drivers. Further, the student-related sections of these plans must be provided to students and parents or guardians. One of the more significant provisions of the law requires that all school staff members are now required to report any act of bullying that they witness to the principal or other official responsible for receiving such reports. Also noteworthy however is the provision that no private lawsuit may be brought based on the failure to comply with this law.
